BaFin Rejects Bitcoin.de Operator's MiCA Application, Forcing Restructure

German cryptocurrency platform Bitcoin.de is completely rebuilding its operational structure after German regulator BaFin rejected its application for authorization under the European Union's Markets in Crypto-Assets (MiCA) regime. The rejection was issued against Futurum Bank AG, the operator of Bitcoin.de, effectively terminating the regulator's prior tolerance of the firm's crypto services.

BaFin Rejection Forces Outsourced Trading Model

The decision leaves Futurum Bank AG unable to operate as an authorized crypto-asset service provider. The regulatory process began when Futurum Bank filed its MiCA application in June 2025, remaining unresolved for more than 15 months before the final rejection.

Trading on Bitcoin.de has been largely suspended since June 12. While customers are still able to withdraw their cryptocurrency, active trading and euro deposits remain halted. Futurum Bank will hold customer assets temporarily until they can be migrated to an external custodian, though customer logins and claims remain unaffected. This enforcement comes amid strict European enforcement deadlines, such as those seen in recent EU crypto exchange regulatory rules.

Alternative Structure and Restructure Plan

To preserve its marketplace serving over 1.1 million customers, Bitcoin.de plans to pivot to a third-party partnership framework. Under the proposed structure, two separate regulated German institutions will handle compliance operations:

  • One regulated partner will act as the direct trading counterparty for users.
  • A second regulated partner will assume responsibility for crypto custody.

Under this arrangement, Bitcoin.de will focus on technology, distribution, and customer relationship management, while retaining its brand, mobile app, and user interface. Bitcoin Group and Futurum Bank noted that technical preparation for the relaunch is complete, leaving regulatory partner execution as the main hurdle. Both entities have a one-month window from formal notification to file an official objection or submit a fresh application.

Key Takeaways

  • BaFin rejected Futurum Bank AG's MiCA application after a 15-month review period.
  • Bitcoin.de will outsource trading and custody to two regulated German institutions.
  • Trading and euro deposits have been halted since June 12, while withdrawals remain active for 1.1 million customers.
  • Futurum Bank has one month to appeal the regulatory decision.

Why It Matters

The rejection highlights the high regulatory barrier established by MiCA across European jurisdictions, demonstrating that historical operational status does not guarantee approval under the new framework. By outsourcing execution and custody to pre-licensed entities, Bitcoin.de is attempting a modular compliance model that could become a template for other struggling platforms. However, the extended trading suspension puts commercial pressure on the platform as its 1.1 million customers face prolonged service disruptions.
